1) Scope

This Policy applies to personal information processed by Quartz when you use our websites, request information about homes or rentals, schedule tours, join our mailing lists, engage with our social media, apply for employment, or interact with our modular construction, transport, and installation businesses (Quartz Modular and Quartz Transport).

This Policy does not cover information processed by third-party websites, platforms, or services we do not control. Their privacy practices are governed by their policies.

2) Notice at Collection (California)

Under the California Consumer Privacy Act (CCPA/CPRA), we provide the following summary of categories of personal information we collect, the purposes for collection, and whether we “sell” or “share” (for cross-context behavioral advertising) such information.

Financial Incentives: We do not provide programs that constitute “financial incentives” under CCPA at this time.

Sensitive Information: We do not use or disclose sensitive personal information for purposes other than those permitted by law (e.g., service delivery, security, short-term transient use).

3) Information We Collect

A) Information You Provide

  • Lead & Contact Forms: name, email, phone, property/community interest, message content.
  • Tour Requests & Services: preferred dates, household info you choose to share.
  • Accounts & Subscriptions: username, password, communication preferences.
  • Payments (if applicable): We use PCI-compliant processors; we do not store full payment card numbers on our servers.
  • Careers: resume/CV, work history, references, eligibility, and any optional demographic data you choose to provide.
  • Events & Surveys: registrations, feedback, reviews, testimonials.

B) Information Collected Automatically

  • Device & Usage: IP address, device type, OS, browser, pages viewed, links clicked, timestamps.
  • Cookies/SDKs: session IDs, preferences, analytics identifiers, advertising identifiers. See Cookies.
  • Location: approximate geo from IP; precise location only if you enable it in your browser or device.

C) Information from Third Parties

    • Marketing & Analytics Partners: aggregated statistics and audience insights.
    • Recruiters/Job Boards: candidate information submitted to us.
    • Referral Sources & Social Media: if you interact with our pages or campaigns.

4) How We Use Information

  • Provide, operate, and improve the Services and our communities and properties.
  • Respond to inquiries, schedule tours, provide quotes, and fulfill requests.
  • Send administrative messages (confirmations, updates, legal notices).
  • Personalize content and communications based on your preferences.
  • Conduct analytics, research, product development, and quality assurance.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Comply with legal obligations and enforce our terms and policies.
  • Recruiting and hiring if you apply to work with us.
  • Marketing and advertising (with opt-out options where required).

Legal Bases (EEA/UK): consent; contract performance; legitimate interests (e.g., Service operation, security, analytics, marketing to the extent permitted); legal obligations; and establishment/exercise/defense of legal claims.

5) How We Disclose Information

  • Service Providers/Processors: hosting, CRM, analytics, email, customer support, payment, recruiting, security.
  • Advertising/Analytics Partners: to measure performance and reach audiences (see Interest-Based Advertising).
  • Affiliates: Quartz Modular, Quartz Transport, and other entities under common control.
  • Business Transfers: in connection with a merger, acquisition, financing, or sale of assets.
  • Legal & Safety: to comply with law, lawful requests, and protect rights, safety, and property.
  • With Your Consent: or at your direction.

We do not sell personal information for monetary consideration. We may “share” personal information for cross-context behavioral advertising if such tools are enabled; you can opt out as described below.

6) Cookies, Tracking & Analytics

We and our partners use cookies, pixels, local storage, and SDKs to operate the site, remember preferences, analyze traffic, and tailor content and ads.

  • Strictly Necessary: core site functions (cannot be disabled).
  • Functional: remember settings and enhance features.
  • Analytics: site usage and performance measurement.
  • Advertising: tailor marketing based on your interests.

7) Interest-Based Advertising (IBA)

We may work with advertising partners to display ads tailored to your interests across websites and apps. These partners may collect information over time about your activity on the Services and other sites.

Opt-Out Options:

  • Use industry tools: DAA, DAAC, EDAA.
  • Adjust mobile ad settings (Limit Ad Tracking/Ad Personalization).

8) Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Policy, including providing services, complying with legal obligations, resolving disputes, and enforcing agreements. Retention periods vary based on data type, legal requirements, and business needs. When no longer needed, we take reasonable steps to delete, de-identify, or aggregate the data.

9) Security

We implement administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure; risks remain. Please use strong, unique passwords and promptly notify us of any suspected unauthorized activity.

10) Children’s Privacy

Our Services are not directed to children under 13 (or under 16 in some jurisdictions), and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.

11) Your Privacy Rights (U.S. State Laws)

Depending on your state (e.g., CA, CO, CT, UT, VA), you may have rights to:

  • Access/know, correct, or delete your personal information.
  • Receive a portable copy of certain information.
  • Opt out of sale, sharing for cross-context advertising, targeted advertising, and certain profiling.
  • Limit the use/disclosure of sensitive information (where applicable).
  • Appeal our response to your request (CO/CT/VA and others).

How to Exercise: Submit a request via our Contact Page. We will verify your identity and respond within the timeframes required by law. Authorized agents may submit requests where permitted, subject to verification.

Opt Out of “Sale”/“Sharing” and Targeted Advertising: Visit Privacy Choices and adjust Cookie Preferences. You can also use a browser-based opt-out signal (e.g., Global Privacy Control), which we will honor to the extent required by law.

Non-Discrimination: We will not discriminate against you for exercising your rights.

12) Your Rights (EEA/UK GDPR)

If you are in the EEA/UK, you may have the right to: access, rectify, erase, restrict processing, object (including to direct marketing), data portability, and withdraw consent (without affecting prior processing). You also have the right to lodge a complaint with your local supervisory authority.

International Transfers: When transferring personal data outside the EEA/UK, we rely on appropriate safeguards (e.g., Standard Contractual Clauses) and implement supplementary measures where needed.

13) “Do Not Track” Signals

Some browsers transmit “Do Not Track” signals. We currently do not respond to these signals. We do, however, recognize certain legally required opt-out preference signals (e.g., Global Privacy Control) as described above.

14) Changes to this Policy

We may update this Policy from time to time. The “Effective Date” indicates the latest revision. Material changes will be posted on this page and, where required, we will provide additional notice.

Appendix – Additional Disclosures

A) Employment Applicants

If you apply for a job, we process information to evaluate candidacy, conduct interviews, manage recruiting, and comply with legal obligations. We may retain applications to consider you for future roles. If hired, your information becomes part of your employee record governed by our internal notices.

B) Property Tours, Sales, and Rentals

To schedule tours or process interest in a home or rental, we use your contact information, preferences, and communications. We may share limited details with service providers (e.g., scheduling, messaging) and affiliated entities involved in community operations.

C) Payments & Financing

Where applicable, payments are processed by third-party payment processors. Financing or credit-related inquiries may be routed to lending partners you choose, who act as independent controllers of your information under their own privacy policies.

D) MLS & Third-Party Listings

If we display or use multiple listing service (MLS) data, your interactions may be shared with listing partners for compliance and lead routing under applicable rules.

E) State-Specific Addenda

Residents of California, Colorado, Connecticut, Utah, Virginia, and other states with comprehensive privacy laws may refer to Section 11 for rights and opt-out mechanisms specific to their state.
